A significant part of our legal activity is representation in inheritance cases and probate proceedings. These cases have become more and more complicated in recent years, thanks to more complex property relationships, family law relationships, see the growing number of cohabitation relationships in addition to marriage.
Here, we would like to draw attention to the fact that, from the point of view of inheritance, cohabitation does not fall under the same judgment as marriage. In terms of inheritance in Hungarian civil law, we distinguish the so-called legal inheritance and testamentary inheritance. The former, as the name indicates, is regulated by law and, to put it simply, the closest descendants and the surviving spouse, with certain restrictions, inherit a child's share together with the benefit of the last shared apartment.
However, it is important to know that if there is a will, the will regulates inheritance. Strict formal requirements apply to the will, so it is recommended to hire a lawyer to prepare it. As we have already mentioned, according to the law, the partner does not inherit, so if someone wants to give his partner a benefit, he must make a will.
